About the Author
Victor Peskin received his Ph.D. in Political Science at the University of California, Berkeley, and is currently an Assistant Professor in The School of Global Studies at Arizona State University. His scholarly and teaching interests lie at the intersection of international relations, comparative politics, and human rights. His research examines the politics of the contemporary international criminal tribunals and their contentious relationship with states implicated in war crimes and genocide. His research has been funded by the United States Institute of Peace and the Institute on Global Conflict and Cooperation. He has published articles in Europe-Asia Studies, Legal Affairs, International Peacekeeping, the Journal of Human Rights, and the Journal of International Criminal Justice.

Remarkable Insight

Victor Peskin has taken a complex and poorly understood issue and laid it bare for us with clarity, sensitivity and intelligence. The book is based on a remarkable amount of reporting, but it is not cluttered at all. His portrayals of the international criminal courts and their struggle with governments harboring war criminals, and his analyses of the wars and massacres in Bosnia, Croatia and Rwanda are all concise and easy to grasp.
An assistant professor at Arizona State University's School of Global Studies, Peskin has little to say about the actual trials taking place at the International Criminal Tribunal for the Former Yugoslavia in The Hague and the International Criminal Tribunal for Rwanda in Arusha. His focus is much different. He examines the enervating struggles of the Chief Prosecutors to persuade, pressure, shame or force the governments of Serbia, Croatia and Rwanda to surrender indicted politicians and military officers to the tribunals. Peskin calls these struggles "virtual trials" -- and all are infused with nationalism and politics.
Peskin shows how the prosecutors, with the help of pressure from the European Union and the US, have cajoled Serbia and Croatia into surrendering a good number of suspected war criminals, including, of course, Serbian President Slobodan Milosevic. But it is infuriating to read the story of how political leaders of every stripe in Serbia have managed to harbor General Ratko Mladic and Radovan Karadzic, the two fugitives responsible for the massacre of Srebrenica and other atrocities in Bosnia.
One of the most fascinating sides of the book is Peskin's discussion of the problems of the Rwanda tribunal in Arusha. This subject has not been covered much by American newspapers, and it is surprising to read how deftly the government of Rwanda has managed to thwart the work of the tribunal. The Tutsi-run government has done so by playing on the world's guilt over its failure to prevent the massacre by Hutu militants of perhaps 800,000 Rwandans, mostly Tutsis, in 1994. Other governments, especially the US, are shamed into supporting whatever the Rwanda government is up to.
But Peskin makes it clear that the Rwanda government is not the government of the Tutsi victims but of the invading army of Tutsi exiles whose actions bear some responsibility for the terrible events. Moreover, the Tutsi army committed massacres of its own against the fleeing Hutu population. Yet the government has managed to prevent the tribunal from trying almost all indicted Tutsi officers. Even its cooperation at turning over alleged Hutu criminals has been tepid. It would rather try them in home courts that, unlike the tribunal, can order the death penalty. Peskin covers these emotional issues with great insight. All in all, this is an extraordinary book.
